Head of Chambers, David Gordon, secured the conviction for Attempted Murder of a dangerous Grimsby criminal following a 7 day trial at Hull Crown Court before Mr Justice Coulson and a jury. Shane Gormally, who had previous convictions for offences involving serious violence, was convicted of breaking into a house at 4.00 am and stabbing a man twice in the back as he slept, the motive being unclear. Only swift surgical intervention and the removal of a kidney prevented the man bleeding to death. The court passed a sentence of Life Imprisonment with 18 years to serve before Gormally can apply for parole.
Gormally was also ordered to pay £20,000 in compensation to his victim. Unusually the defendant had the funds to recompense his victim as he had only the day before the attack himself received compensation of £25,000 from the Ministry of Justice. Having been sentenced to 12 years imprisonment in 2000 in relation to an offence of section Causing Grievous Bodily Harm with Intent Gormally had been released on licence then later recalled for breaching the terms of his licence. However he had been recalled under the wrong regulations and was therefore deemed to have been "falsely imprisoned" by the state for 14 months, hence the compensation.
