Judy Dawson has recently won a case on behalf of Liverpool Victoria in which they faced a credit hire claim of almost £100,000 in addition to other special damages and other intimated claims amounting to a quarter of a million pounds.
After a full trial in Manchester, the judge found that the entire claim was fraudulent and awarded costs against the Claimants on an indeminity basis.
The case involved a young lady driving an S4 Audi convertible who attempted to hide behind a facade of respectability and claimed that she needed to hire a Range Rover Sport at over £191 per day "to maintain her image".
The insurers were faced with large Claimants solicitors' costs schedules making it a commercially-risky decision to run the trial but their robust approach has been rewarded. Painstaking investigations by the solicitors and insurers ensured that the carefully constructed image of the female Claimant as an innocent victim was able to be dismantled in Court, exposing her as a dishonest fraudster".
