James Keeley has again successfully argued that identification evidence by Police Officers in Breach of Code D 3.34-3.37 of PACE should be excluded. Mr Keeley says:
“...it seems that the police are not up to speed with the requirements that Code D places on them when being asked to identify people from CCTV footage or photographs. An accurate record needs to be taken during such identity procedures. If this is not done there is a breach of Code D and the real possibility of a successful section 78 argument. In this case the omission led to the acquittal of my Defendant client.”
