
There has been a vast increase in the volume of regulation in recent years, much of which is now enforced by criminal sanctions. There are few areas of industry or commerce which remain unaffected by primary or secondary legislation creating detailed regulatory frameworks. At the same time many professional bodies have completely overhauled the way in which they operate and many have split their representative and disciplinary functions, creating new agencies to regulate their members.
Chambers’ Regulatory and Disciplinary team was created to draw together the wealth of experience in chambers criminal, family and civil teams and meet the needs of corporate clients in dealing with the ever-increasing burden of ensuring compliance with regulatory and disciplinary law. Many members of the team also prosecute for those agencies responsible for policing the regulations.
Some areas of regulation such as environmental and health and safety rules are well known and are of general application to large numbers of companies. Other areas are as highly specialised as the activities that they seek to control. Members of our team have recently been involved in cases involving a wide range of regulators including the Department for Trade and Industry, the Department for Work and Pensions, HM Revenue and Customs, the Food Standards Agency, the Department of Health, the Health and Safety Executive, the Medicines and Healthcare Products Regulatory Authority, the Environment Agency and the Child Support Agency. We recently conducted the first ever prosecution of an employer for failing to pay the minimum wage.
All members of our team have been trained in the particular issues which arise when corporate bodies are brought before the criminal courts and are well used to representing corporate clients. Similarly, we understand the position of professionals whose conduct is being scrutinised by their disciplinary tribunals. Team members have recently represented healthcare professionals, accountants and police officers before their respective professional bodies.
